GENERAL TERMS AND CONDITIONS

1. Introduction and Contracting Rules

This contract constitutes the General Terms and Conditions for the online sales services provided on this website by AREA MAUROS S.A., hereinafter AREA MAUROS, for the service purchaser, "THE USER".

The USER declares that each and every piece of data and information provided is correct, and that they are aware of and fully accept these TERMS AND CONDITIONS.

 

2. User's Personal Data

The personal data provided by the USER is confidential and protected in accordance with the Personal Data Protection Act, security measures relating to automated files containing personal data, and any other applicable regulations.

However, the USER should be aware that internet security measures are not infallible.

Under no circumstances will USERS' personal data be used for purposes other than those described in these TERMS AND CONDITIONS.

USERS have the recognized rights of access, cancellation, rectification, and objection to the processing, use, and transfer of their data, which they may exercise by sending a communication to AREA MAUROS at the email address reservas@apartamentoslasciencias.es, stating their full name, the specific request, and an email address.

The USER authorizes the transfer of their personal data to third parties involved in the provision of the service(s).

 

3. Intellectual Property

The texts and graphic elements that constitute and are disseminated by this website, as well as its presentation and layout, are the exclusive property of AREA MAUROS. Therefore, they constitute works protected as such by all European Union regulations in the field of intellectual property, and the international treaties signed in this field are also applicable.

AREA MAUROS does not grant any license or authorization for the use of its industrial and intellectual property rights or any other property or rights related to this website, except by express agreement with third parties.

Users may reproduce the website's content solely for the purpose of storing it, creating backup copies, or printing it on paper.

 

4. Purpose

These GENERAL TERMS AND CONDITIONS define the conditions under which AREA MAUROS provides the Service(s) that the USER accepts without reservation or restriction.

These GENERAL TERMS AND CONDITIONS may, where applicable, be supplemented by specific conditions or sales modifications, in which case the applicable conditions will be those received with the confirmation.

The USER's acceptance and/or validation of an application form issued by AREA MAUROS implies the unreserved acceptance of these GENERAL TERMS AND CONDITIONS.

 

5. Service Provision and Method of Provision

Use of the website by the offered USERS is free of charge, and the USER is not required to pay any consideration for such use.

The USER may contract one or more of the services specified on the website. This contract may be entered into at any time during the term of this agreement, subject to the USER's acceptance of the conditions stipulated herein.

The provision of these services will be governed by the TERMS AND CONDITIONS established in this agreement, and where applicable, by the corresponding Specific Conditions for services that so specify. This provision is based on the USER's contracting of any of the services offered by AREA MAUROS on its website.

 

6. Modification of the Terms and Conditions

The TERMS AND CONDITIONS may be modified, and any changes will be communicated to USERS through a notice on the website.

The modification or cancellation of one or more agreements contained in this agreement does not imply the cancellation or invalidity of the other agreements or the termination of the contractual relationship with the USERS.

 

7. Liability

SERVICE PROVIDER'S

AREA MAUROS is not liable for damages arising from any of the following:

7.1. The alteration of privacy and security in the use and content of the website and services provided by third parties not affiliated with this agreement, in accordance with current legislation.

7.2. The presence of false elements in services offered by third parties through the website that may cause alterations to the USER's computer system, electronic documents, or files.

7.3. The lack of truthfulness, accuracy, completeness, and timeliness of the content offered by third parties.

7.4. The lack of legality, reliability, and usefulness of the content of services offered by third parties through the website.

USER'S

The USER is solely and exclusively responsible for their login credentials and their use of the website and services. Aware of this, the USER voluntarily accepts such responsibility.

 

8. Early Termination

AREA MAUROS may terminate the contract early, without prior notice, by denying or withdrawing access to the website, services, or content to any USERS who breach these TERMS AND CONDITIONS.

 

9. Duration and Termination

The provision of the website service is for an indefinite period. However, AREA MAUROS has the right to terminate or suspend the provision of the website service and/or any of the services at any time, without prejudice to the provisions set forth in the corresponding TERMS AND CONDITIONS. When reasonably possible, AREA MAUROS will provide prior notice of the termination or suspension of the website service.

Apart from the foregoing, any reproduction or presentation of the content of this website or any of its elements for commercial purposes or for any use beyond those mentioned above is prohibited without the express written authorization of AREA MAUROS. Failure to comply with the above will entitle AREA MAUROS to take appropriate legal action to defend its interests.

The USER grants AREA MAUROS the right to use advertising material designed to promote the website apartamentoslasciencias.es, both online (blogs, social media, banners, etc.) and offline (catalogs, posters, brochures, advertisements, etc.). The above lists are for illustrative purposes only.

The USER grants AREA MAUROS the right to share this material on various social media platforms, acknowledging that AREA MAUROS cannot control the reach of such dissemination. The USER may not demand that AREA MAUROS remove the posts from social media, nor may they hold AREA MAUROS liable for any content shared and disseminated by third parties.

 

SPECIFIC SERVICE CONDITIONS

1. Service Description

AREA MAUROS publishes accommodation and experience listings, providing an information service for THE USER.

Based on the USER's search criteria (destination, arrival date, number of nights, amenities, neighborhood, etc.), the AREA MAUROS website automatically publishes and generates the accommodation listing. If THE USER is interested in an accommodation listing, they must send a booking request to AREA MAUROS, which offers a booking confirmation service. The contact information and address of the accommodation will be provided in the final confirmation.

 

2. Booking Request Acceptance and Confirmation

AREA MAUROS uses all available resources to ensure accurate availability on online accommodation calendars. However, it cannot guarantee that the accommodation listing will still be available at the time the booking request is processed.

AREA MAUROS reserves the right to reject the user's booking request and make new offers, without being liable for any consequences this may have for the USER.

Once the USER's booking request has been received, AREA MAUROS will charge the USER for the services via credit card or any other payment method offered on the website. The USER will receive final confirmation by email, which is the acceptance of their booking request and the final step in the AREA MAUROS booking service.

 

3. Prices

  • The total price includes gas, electricity, and water consumption for rental contracts of 30 nights or less.
  • For rental contracts longer than 30 nights, gas, electricity, and water consumption will be billed as detailed in point 4 of these terms and conditions.
  • The prices of all accommodations published on apartamentoslasciencias.es are final prices, including VAT.
  • Under no circumstances does the total price include telephone charges incurred for the use of telecommunications services such as mobile phone or Wi-Fi; these charges must be billed separately and the USER will pay them directly to AREA MAUROS.

 

4. Payments

The USER must pay 30% (LOW SEASON) or 50% (MID or HIGH SEASON) of the total reservation amount upon confirmation. Payment terms are described in each accommodation offer.

Payment will be made by one of the following methods:

Bank POS terminal (online or physical).

Credit card. (For proper verification of the cardholder's identity, the cardholder must present the card upon arrival at check-in when requested. Failure to comply with this requirement will result in being denied entry to the accommodation, with access only possible by purchasing a new reservation at that time. For this reason, virtual cards cannot be used as the physical card cannot be presented. The cardholder of the credit card used to make the online reservation must be present at check-in. If the cardholder is not present, the credit card will not be accepted.)

Bank transfer to AREA MAUROS' bank account number.

Please note that the reservation will not be confirmed until AREA MAUROS has received full payment, verified accommodation availability, and the USER has received their booking confirmation by email.

AREA MAUROS will request a security deposit from the USER upon arrival, which may range from €100 to €250, depending on the apartment.

Utilities are included in the price, except for stays longer than 30 days, in which case water, electricity, and gas are included in the booking price up to a maximum of:

  • €120/month for 1-bedroom apartments.
  • €150/month for 2-bedroom apartments.
  • €200/month for apartments with 3 or more bedrooms.

These amounts are calculated based on responsible consumption. Any excess will be charged to the USER upon presentation of receipts.

The minimum stay will be specified for each apartment depending on the season.

 

5. Cancellation by the User

If the USER cancels the reservation due to unforeseen circumstances or force majeure—whether for part or all of the stay—the total reservation amount is non-refundable.

AREA MAUROS reserves the right to claim the full amount as a deposit during peak periods (Summer from July 1st to September 15th, Fallas, Easter Week, long weekends, and holidays).

 

For this PEAK SEASON, the following cancellation policy will apply:

Up to 30 days before arrival: the establishment will charge 0% of the total stay.

Between 29 and 0 days before arrival: or in case of no-show: the establishment will charge 100% of the total stay.

 

For MID-SEASON (January 1st to 8th, April 16th to June 30th, and December 10th to December 31st), the following cancellation policy will apply:

Up to 14 days before arrival: the property will charge 0% of the total stay.

Between 13 and 7 days before arrival: the property will charge 50% of the total stay.

Between 6 and 1 days before arrival, or in case of no-show: the property will charge 100% of the total stay.

 

For LOW SEASON (all other dates), the following cancellation policy will apply:

Up to 7 days before arrival: the property will charge 0% of the total stay.

Between 6 and 0 days prior to arrival: the property will charge 50% of the total stay. No-shows will incur a 100% charge.

All refunds will be issued via the same payment method used by the USER. To avoid these situations, AREA MAUROS recommends purchasing travel insurance.

 

6. Cancellation by our company

6.1. AREA MAUROS reserves the right to cancel – in whole or in part – the aforementioned reservation due to force majeure, or for any other reason, with prior written notice to the USER.

6.2. In the event of cancellation of the reservation by AREA MAUROS, in accordance with the provisions of the preceding paragraph, AREA MAUROS must refund the USER 100% of the reservation amount. AREA MAUROS will not be liable for any damages, losses, or direct or indirect costs resulting from this cancellation.

AREA MAUROS reserves the right to change the apartment booked by the USER for another of similar characteristics or a higher category.

 

7. Apartment Change Requested by the User

If, after booking confirmation, the USER wishes to change apartments, they must send an email to reservas@apartamentoslasciencias.es explaining that they wish to cancel their initial booking and reserve a new apartment. The USER must then book the new apartment. After the new booking is confirmed, the initial booking will be canceled.

In this case, AREA MAUROS reserves the right to charge cancellation fees for the initial booking, which may amount to up to 100% of the canceled booking amount.

 

8. Security Deposit

AREA MAUROS requires a security deposit to guarantee the proper use of the accommodation upon the USER's arrival. This deposit ranges from €100 to €250, depending on the apartment. This amount will be refunded up to 48 hours after the USER's departure, provided the apartment is in perfect condition.

The security deposit will not be refunded in full or in part if any damage caused by the USER is found in the apartment or its furnishings. Similarly, AREA MAUROS will charge the USER €25 if the apartment is found in unreasonable condition upon departure (e.g., dirty kitchen utensils, trash, furniture moved, etc.).

AREA MAUROS reserves the right to refuse entry to USERS who have not paid the required security deposit.

Under no circumstances may the USER use the security deposit as part of the payment they are obligated to make.

 

9. Amenities / Cleaning

All our guests will have a complete set of sheets and towels suitable for the number of guests staying in the apartment. Additionally, a cleaning of the apartment before the guests' arrival is included in the price.

The final cleaning of the apartment is included in the total price of the guest's reservation. If you wish to contract other cleaning services, you can do so by contacting reservas@apartamentoslasciencias.es.

 

10. Check-In

All our guests must check in online using the link that AREA MAUROS will send them. Subsequently, a few hours before arrival, AREA MAUROS will provide you with an access code to the reserved apartment.

Check-in will take place from 4:00 PM onwards. If you are arriving before the established time, we will try to accommodate your early check-in, always subject to availability and upon prior request.

 

11. Check-Out

Check-out time is until 11:00 AM. If you need to check out later or earlier, please contact AREA MAUROS as soon as possible, and we will try to accommodate you. An additional charge may apply.

 

12. Use of the Accommodation

The accommodation is intended for use by holiday or business travelers. Under no circumstances may the accommodation be used for commercial purposes without prior consent. Therefore, the USER declares that they are renting the accommodation for the purpose of their holiday or business trip. Under no circumstances may the accommodation rented under the terms of this contract be used as a primary residence.

 

13. Condition and Maintenance of the Accommodation

The USER must preserve and maintain the accommodation in good condition until the end of their contract, as freely agreed upon by the parties mentioned herein. In the event of damage to or loss of the property by the USER or any of the guests staying at the property, the USER agrees to pay AREA MAUROS the corresponding amount for the damages caused.

 

14. Rules of Conduct

The USER shall be responsible for the proper and decent conduct of all accompanying persons, in accordance with the accommodation rules mentioned below. If the USER, or any accompanying person, does not respect the required rules of conduct and accommodation, AREA MAUROS has the right to ask the USER and their companions to leave the property, forfeiting the right to any subsequent claims and any type of compensation.

 

15. Accommodation Rules

15.1. The person in whose name the reservation is made must be at least 18 years old and be the same person using the apartment. At the time of booking, the number of people using the accommodation must be specified, and this number must be the same as the number of occupants. The accommodation's capacity may never be exceeded, except with children under 3 years old.

15.2. The USER must respect the neighbors of the property: peace and quiet must be maintained and respected at all times. Therefore, the USER must not make noise in the stairwell or in the apartment.

15.3. In the event of a complaint from the neighbors due to excessive noise or disruptive behavior by the USER, AREA MAUROS has the right to require the USER to vacate the property immediately, without any refund of the amount paid for the reservation or the security deposit.

15.4. Guests must respect the rules of the building's Owners' Association where the accommodation is located, as well as the proper use of its common elements and facilities.

15.5. Garbage must be deposited in the designated containers according to the established schedule.

15.6. The USER must respect the smoking ban.

15.7. Pets are not allowed. If necessary, AREA MAUROS must be consulted beforehand.

15.8. If the USER leaves the apartment, they must ensure that all lights are turned off, and that the air conditioning and heating are set to the minimum or turned off.

 

16. Contract Termination

These General and Specific Conditions must be effective and accepted online from the date of the first booking request.

 

17. Reservation Assignment

This reservation is made in the name of the USER and cannot be transferred, in whole or in part, to another person.

 

18. Compensation

AREA MAUROS is exempt from liability for any damage or injury that may occur to the USER or their companions, as well as to their shared property, caused by equipment or structures of the accommodation, or by services provided to the accommodation, losses due to theft, fire, criminal activity, among others.

In the event of a breakdown unrelated to misuse by the USER that makes staying in the apartment impossible, AREA MAUROS is responsible for repairing it as soon as possible, after notification by the USER. If it is not possible to repair the problem for any reason, AREA MAUROS will find an apartment of similar or superior characteristics.

All guests explicitly declare that they will use the apartment at their own risk and release AREA MAUROS from any liability for compensation.

It is the guest's responsibility to pay for lost keys and cover the additional cost of changing the lock. Losing or forgetting keys inside the apartment and having to travel to open it will incur an additional charge of €50. If a professional locksmith is required, the guest will also pay the full amount.

In the event of preventive isolation or quarantine, AREA MAUROS is not responsible for any expenses that may be incurred. If there is a confirmed case of COVID-19 with symptoms consistent with the virus, the protocol established by the Spanish Ministry of Health will be followed.

 

19. Termination

In the event of early termination of this contract by the USER, without any breach on the part of AREA MAUROS, the USER shall not be entitled to any refund of the price or any expenses paid.

 

20. Jurisdiction

These terms and conditions have been drafted in accordance with Spanish law, and therefore any interpretation thereof shall be governed by Spanish law. Any dispute relating to accommodation bookings made through AREA MAUROS shall be subject to the exclusive jurisdiction of the Spanish courts.
